5 Use of information

Visiting the Uebersax Branding website is generally possible without providing any personal data. Impersonal usage data, such as IP address, browser used, date, time, etc., is analyzed without drawing conclusions about your identity.

Visitors to our website can also activate the "do not track" function in their browser so that only the login itself is tracked.

Personal data is collected and processed strictly in accordance with relevant laws and regulations and, as a rule, only with your express consent.

6 Disclosure of personal data

We treat your personal data confidentially and only disclose it if you have expressly consented, if we are legally obligated or entitled to do so, or if it is necessary to enforce our rights, particularly to assert claims arising from the contractual relationship. Furthermore, we disclose your personal data to third parties to the extent necessary or appropriate for the use of the website or for the potential provision of services you have requested.

We disclose your personal data to the following categories of recipients:

  • business partners
  • service operators
  • service providers
  • authorities, to the extent necessary or required

In doing so, we naturally comply with legal requirements regarding the transfer of personal data to third parties. If we engage third parties to provide our services, we take appropriate legal precautions as well as suitable technical and organizational measures to ensure the protection of your personal data in accordance with the relevant legal provisions.

If the level of data protection in a country where data is processed does not meet applicable data protection regulations, we contractually ensure that the protection of your personal data is equivalent to that in Switzerland or the European Economic Area (EEA) at all times.

7 Contact options via the website

If you contact Uebersax Branding via our website, the personal data you transmit will be stored automatically. Such data transmitted on a voluntary basis is stored exclusively for the purpose of processing your request or contacting you. Our legitimate interest lies in processing your contact requests. This personal data is not passed on to third parties.

You may object to this data processing at any time. Please send your objection to hi@uebersaxbranding.ch. In this case, your data will be deleted and your request will not be processed further, provided that there are no legal retention obligations to the contrary.

8 Routine deletion and blocking of personal data

Unless expressly stated in this privacy policy, Uebersax Branding processes and stores personal data of data subjects only for the period necessary to achieve the purpose of storage, or as provided for by legal requirements to which Uebersax Branding is subject.

If the purpose of storage no longer applies or if a statutory retention period expires, personal data will be routinely blocked or deleted in accordance with legal requirements.

9 Legal basis for processing

No data is processed without a legal basis. The following serve as such:

  • consent
  • the conclusion or performance of a contract or a request from the data subject in advance thereof (pre-contractual)
  • legal obligations
  • the protection of a legitimate interest of Uebersax Branding or a third party
  • vital interests, where applicable
10 Rights of the data subject

a) Right of access

Any person affected by the processing of personal data has the right to obtain confirmation as to whether personal data concerning them is being processed, and to receive free information about this data, as well as further information and a copy of the data, in accordance with legal requirements.

b) Right to rectification

Any person affected by the processing of personal data has the right to request the immediate rectification of inaccurate personal data concerning them and/or the completion of incomplete personal data.

c) Right to erasure (right to be forgotten)

Any person affected by the processing of personal data has the right, in accordance with legal requirements, to request that the personal data concerning them be deleted without undue delay.

d) Right to restriction of processing

Any person affected by the processing of personal data has the right, in accordance with legal requirements, to request the restriction of processing.

f) Right to data portability

Any person affected by the processing of personal data has the right, in accordance with legal requirements, to receive the personal data concerning them, which they have provided to Uebersax Branding, in a structured, commonly used, and machine-readable format, or to request its transmission to another controller.

e) Right to object

Any person affected by the processing of personal data has the right to object at any time to the processing of personal data concerning them. This also applies to profiling based on these provisions.

In the event of an objection, Uebersax Branding will no longer process the personal data unless compelling legitimate grounds for the processing can be demonstrated which override the interests, rights, and freedoms of the data subject, or if the processing serves the assertion, exercise, or defense of legal claims.

f) Automated individual decision-making, including profiling

In accordance with legal requirements, any person affected by the processing of personal data has the right not to be subject to a decision based solely on automated processing—including profiling—which produces legal effects concerning them or similarly significantly affects them.

g) Right to withdraw consent under data protection law

Any person affected by the processing of personal data has the right to withdraw their consent to the processing of personal data at any time, with effect for the future. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

h) Right to lodge a complaint with a supervisory authority

Depending on the applicable data protection legislation, the person affected by the processing of personal data may have the right to lodge a complaint with a competent data protection authority.

Please note that exceptions apply to these rights. In particular, Uebersax Branding may need to continue processing and storing personal data to fulfill a contract with you, to protect its own legitimate interests—such as the assertion, exercise, or defense of legal claims—or to comply with legal obligations. To the extent permitted by law, Uebersax Branding may therefore decline your data protection requests or comply with them only to a limited extent.

11 Collection, processing, and use of personal data

11.1 Personal data

Personal data is information regarding the factual or personal circumstances of a specific or identifiable natural person. This includes, for example, your name and your email address.

11.2 Use of your data for advertising purposes

In addition to using your data for sending the newsletter, we also use your data to display personalized advertising to you.

You can object to the use of your personal data for advertising purposes at any time; please send your objection to hi@uebersaxbranding.ch.

11.2.1 Newsletter

When you sign up for our newsletter, the personal data you provide is stored for the purpose of sending you the newsletter. The newsletter informs you about us and our offerings.

If you would like to subscribe to our newsletter, the information marked with an * (self-declared) is mandatory.

For sending the newsletter, we use the double opt-in procedure, which means that we will only send you a newsletter via email once you have expressly confirmed that you consent to receiving it. We will then send you a notification email and ask you to confirm that you wish to receive our newsletter by clicking on a link contained in that email. If you later decide you no longer wish to receive newsletters from us, you can unsubscribe at any time. An unsubscribe link can be found in every newsletter sent.

11.2.2 Service recommendations via email

As a Uebersax Branding customer, you will occasionally receive product or service recommendations from us via email. You receive these recommendations from us regardless of whether you have subscribed to a newsletter. We want to provide you with information about products from our range that might interest you based on your recent purchases from us. We strictly adhere to legal requirements in this regard. If you no longer wish to receive product recommendations or any promotional messages from us, you can object to this at any time without incurring any costs other than the transmission costs according to the basic rates. An email to hi@uebersaxbranding.ch is sufficient for this. Of course, you will also find an unsubscribe link in every email.

12 Cookies

This website uses cookies. Cookies are small text files that are stored permanently or temporarily when you visit this website. The purpose of these cookies is, in particular, to analyze the use of this website for statistical evaluation and for continuous improvement.

You can deactivate cookies in your browser settings at any time, either in whole or in part. If cookies are deactivated, you may no longer have access to all the functions of this website.

12.1 What are cookies?

Cookies are small files that are stored on your device and save specific settings and data for exchange with our system via your browser.

There are generally two different types of cookies: session cookies, which are deleted as soon as you close your browser, and temporary/permanent cookies, which are stored on your device for a longer period or indefinitely. This storage helps us design our websites and offerings for you accordingly and makes your use easier by, for example, saving certain inputs so that you do not have to repeat them constantly.

12.2 Which cookies does Uebersax Branding use?

Most of the cookies we use are automatically deleted from your hard drive after the end of the browser session (session cookies). In addition, we also use cookies that remain on your hard drive. When you visit again, it is then automatically recognized that you have been with us before and which inputs and settings you prefer.

These temporary or permanent cookies (lifespan of 1 month to 10 years) are stored on your hard drive and delete themselves after the specified time. These cookies, in particular, serve to make our offering more user-friendly, effective, and secure. Thanks to these files, it is possible, for example, to have information displayed on the site that is specifically tailored to your interests.

The sole purpose of these cookies is to adapt our offering to your customer preferences as best as possible and to make your browsing experience with us as comfortable as possible.

12.3 What data is stored in the cookies?

Only pseudonymous data is stored in the cookies used by Uebersax Branding. When a cookie is activated, an identification number is assigned to it, and your personal data is not linked to this identification number. Your name, IP address, or similar data that would allow the cookie to be linked to you are not included in the cookie. Based on cookie technology, we only receive pseudonymized information, for example, about which pages of our website were visited, which services, articles, or cases were viewed, etc.

14.4 What is onsite targeting?

On the Uebersax Branding website, data is collected based on cookie technology to optimize our advertising and our entire online offering. This data is not used to identify you personally, but serves solely for a pseudonymous evaluation of how the homepage is used. Your data is never merged with the personal data we have stored.

With this technology, we can present you with advertising and/or special offers and services whose content is based on information obtained in connection with clickstream analysis (for example, advertising tailored to the fact that only content on topics such as strategy or design has been viewed in the last few days).

Our goal is to make our online offering as attractive as possible for you and to present you with advertising that matches your areas of interest.

12.5 Are there also third-party cookies?

Uebersax Design works with advertising partners who help make our online offerings and website more interesting for you. Therefore, cookies from partner companies are stored on your hard drive when you visit the website. These are temporary/permanent cookies that are automatically deleted after the specified time. These temporary or permanent cookies (lifespan of 14 days to 10 years) are stored on your hard drive and delete themselves after the specified time.

The cookies from our partner companies also contain only pseudonymous, and often even anonymous, data. This includes, for example, information about which products you have viewed, whether a purchase was made, which products were searched for, etc. Some of our advertising partners also collect information beyond our websites about which pages you have visited previously or which products you were interested in, in order to display advertising that best matches your interests.

This pseudonymous data is never merged with your personal data at any time. Its sole purpose is to enable our advertising partners to show you advertisements that may actually be of interest to you.

12.6 Re-targeting

Our websites use so-called re-targeting technologies. We use these technologies to make our online offerings more interesting for you. This technique allows us to target internet users who have already shown interest in our website and the offers presented there with advertising on our partners' websites.

We are convinced that displaying personalized, interest-based advertising is generally more relevant to internet users than advertising that has no such personal connection. These advertisements are displayed on our partners' sites based on cookie technology and an analysis of previous usage behavior. This form of advertising is completely pseudonymous. No usage profiles are merged with your personal data.

The basis on which we process your personal data using cookies depends on whether we ask for your consent. If we ask for your consent and you agree to the use of cookies, the basis for processing your data is your consent. If we do not obtain your consent, we process the personal data collected via cookies based on our legitimate interests (e.g., in analyzing and optimizing our services and offerings) or, if the use of cookies is necessary, to fulfill our contractual obligations.

12.7 How can you prevent cookies from being stored?

You can configure your browser to only accept cookies if you provide your consent. If you wish to accept UebersaxBranding cookies but not those from our service providers and partners, you can select the "Block third-party cookies" setting in your browser.

Typically, the help function in your web browser's menu bar will show you how to reject new cookies and disable existing ones. Alternatively, you can visit https://www.aboutcookies.org. There, you will find step-by-step instructions on how to control and delete cookies in most browsers.

If you are using a shared computer that is set to accept cookies and Flash cookies, we recommend that you always log out completely after you have finished your session.

13 Log Files

Each time you access the Uebersax Branding pages, usage data is transmitted by your internet browser and stored in log files, known as server log files. The stored data records contain the following information: date and time of access, name of the page accessed, IP address, referrer URL (the source URL from which you arrived at the website), the amount of data transferred, and product and version information of the browser used.

User IP addresses are deleted or anonymized after use. In the case of anonymization, the IP addresses are modified in such a way that the individual details about personal or factual circumstances can no longer be attributed to a specific or identifiable natural person, or only with a disproportionate amount of time, cost, and effort.

We analyze these log file records in an anonymized form to further improve our services and make them more user-friendly, to find and fix errors faster, and to manage server capacities. For example, this allows us to understand when the Uebersax Branding website is most popular and to provide the corresponding data volume to ensure you have the fastest possible shopping experience. Furthermore, by analyzing the log files, we can detect and fix any errors on the Uebersax Branding website more quickly. These purposes also constitute our legitimate interest in data processing.

14 Web Analysis

This website uses various services for website analysis and tracking, which we explain in more detail below. We also show you how you can prevent these services from evaluating your usage behavior on our website. Where we ask for your consent to use third-party services, the legal basis for this form of data processing is your consent. If we do not obtain your consent, your personal data will be processed on the basis of our legitimate interests (i.e., for optimization and marketing purposes and to design our website according to your interests).

14.1 Google Analytics

This website uses Google Analytics, a web analysis service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, or, if you have your habitual residence in the European Economic Area (EEA) or Switzerland, Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google").

Google Analytics uses "cookies." The information generated by the cookie about your use of our website (including your IP address) may be transmitted to and stored on a Google server in the USA.

We use Google Analytics only with IP anonymization enabled. This means your IP address is truncated by Google within Switzerland or the EU/EEA.

Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there.

Google uses this information to evaluate your use of our website, to compile reports on website activity for us, and to provide other services related to website and internet usage. Google may also transfer this information to third parties if required by law or if third parties process this data on Google's behalf. The IP address transmitted by your browser as part of Google Analytics will not be merged with other data held by Google.

You can prevent the storage of cookies by adjusting your browser software settings; however, please note that if you do so, you may not be able to use all the features of our websites to their full extent.

You can also prevent Google from collecting and processing data by downloading and installing the browser plugin available at the following link: https://tools.google.com/dlpage/gaoptout?hl=de. An opt-out cookie will be set to prevent your data from being collected during future visits to our website.

For more information on Google Analytics and data protection, please visit www.google.com/analytics/terms/de.html or https://policies.google.com/privacy
